Elder Abuse       

 

There is Criminal Elder Abuse and Civil Elder Abuse.  Both Criminal and Civil Elder Abuse are entangled.  One main difference is that with Criminal Elder Abuse, it is up to the state of California to charge someone for abusing an elder.  Civil Elder Abuse, allows the elder or someone acting on behalf of the elder to bring a claim for Elder Abuse themselves and seek monetary damages. 

 

Elder abuse can be physical abuse, neglect, financial abuse, abandonment, isolation, abduction, or other treatment resulting in harm, pain or mental suffering to an elder. It also means the deprivation by a care custodian of goods or services that are necessary to avoid physical harm or mental suffering. (Welfare & Institutions Code Section 15610.).
